Descripción del trámite
This procedure can be used to file a clemency application with the CNMC, either for exemption, abbreviated exemption or a reduced fine.
This request may be filed by the leniency applicant or its legal representative, be it a legal or physical person with an electronic signature.
The applications will be received directly by the Subdirección de Cárteles y Clemencia de la Dirección de Investigación of the CNMC.
Instrucciones
Clemency requests will contain the information and be accompanied by the evidence of the cartel indicated in Article 46.3 of Real Decreto 261/2008, de 22 de febrero, por el que se aprueba el Reglamento de Defensa de la Competencia (hereinafter, RDC).
However, the Dirección de Investigación may set a deadline for presenting the evidence of the cartel if a justified request is made by the applicant for exemption from payment of the fine, in which case the applicant must complete the field indicated in the form mentioned above.
In any case, the leniency application, with the name indicated by the applicant, must contain the following information, as required in the form contained in Annex I of the aforementioned Resolution:
- Information regarding the identification of the applicant
- Information on the other participants in the cartel
- Detailed description of the cartel
- Objectives
- Activities and operation
- Affected products, services and territories
- Estimated duration
- Nature of the cartel
- List of leniency applications that the applicant has submitted or will submit to other competition authorities in relation to the same cartel.
The form in the Electronic Registry offers the possibility to provide the contact details of the leniency applicant to facilitate subsequent communication with the CNMC. It is recommended that these details be entered.
The submission of a clemency request through the Electronic Registry of the CNMC will automatically entail the issuance of a receipt for the filing of the application, which will include the data provided by the leniency applicant, the date and time when said submission was made in the Electronic Registry and a registry entry number. The issuance of this receipt will not imply the issuance of the receipt of the presentation of a request for exemption or reduced fine amount, regulated in the RDC, which will be sent by the CNMC upon express request by the leniency applicant, once the CNMC determines that it is the appropriate body to process said request, pursuant to Ley 15/2007, de 3 de julio, de Defensa de la Competencia, and Ley 1/2002, de 21 de febrero, de Coordinación de las competencias del Estado y las Comunidades Autónomas en materia de Defensa de la Competencia.

Regarding the representation documentation, if the request is filed by the representative of the leniency applicant, a digitised copy of the power of representation must be attached.

Technical requirements
Digital Certificate
A digital certificate for a natural or legal person or representative that has been issued by any provider of certification services that has made the required notification to the Ministerio de Asuntos Económicos y Transformación Digital, pursuant to Article 30 Ley 59/2003, de 19 de diciembre, de firma electrónica, and by the DNI-e, issued by the Dirección General de la Policía.
